Terms of Service

These Terms of Service ("Terms") govern your use of services provided by Texas Hail & Dent Co. ("Company," "we," "our," or "us"), a hail damage repair and paintless dent repair (PDR) specialist located in Abilene, Texas.

By requesting an estimate, scheduling repairs, or engaging our Licensed Adjusters for insurance coordination, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Services Offered

Texas Hail & Dent provides the following services:

  • Paintless Dent Repair (PDR): Removal of hail dents, door dings, and minor collision damage without paint or body filler
  • Panel Replacement & Refinishing: Repair or replacement of panels beyond PDR tolerance, refinished to OEM specifications
  • Insurance Claim Coordination: Licensed Adjusters negotiate with insurance carriers to maximize claim value and eliminate deductibles where applicable
  • Mobile Services: Vehicle pickup and delivery at your home or workplace (subject to service area availability)
  • Free Damage Assessments: Preliminary estimates provided at no charge

Service Area

We primarily serve Abilene and surrounding West Texas counties including Taylor, Jones, Nolan, Callahan, and portions of Lubbock, Midland, and Ector. Service availability for locations outside our primary area is determined on a case-by-case basis.

2. Estimates and Authorization

Free Estimates

All damage assessments and repair estimates are provided free of charge. Estimates are based on visual inspection and may be adjusted if additional damage is discovered during repair.

Work Authorization

No repair work will commence without your explicit written or verbal authorization. By authorizing work, you agree to:

  • Pay for services rendered (unless covered 100% by insurance)
  • Allow our technicians to access your vehicle for the duration of repairs
  • Provide accurate vehicle and insurance information
  • Notify us immediately of any changes to your insurance claim status

Scope Changes

If we discover additional damage during repair that was not visible during initial inspection, we will contact you for authorization before proceeding. Additional work may result in revised timelines and costs.

3. Insurance Claim Coordination

Licensed Adjuster Services

Our Certified Licensed Adjusters are authorized to negotiate with insurance carriers on your behalf. By engaging our insurance coordination services, you:

  • Authorize us to communicate directly with your insurance carrier and assigned adjuster
  • Grant permission to submit repair estimates, damage documentation, and invoices to your carrier
  • Understand that we will advocate for maximum claim value and zero-deductible processing where applicable
  • Acknowledge that final claim approval is at the discretion of your insurance carrier

No Guarantee of Coverage

While our Licensed Adjusters work to maximize your claim, we cannot guarantee that your insurance carrier will approve full coverage or eliminate your deductible. Insurance claim outcomes depend on your policy terms, coverage limits, and carrier protocols.

Client Responsibility

You remain responsible for:

  • Maintaining active insurance coverage throughout the claim process
  • Any deductible amount your carrier requires (unless we successfully negotiate waiver)
  • Any repair costs exceeding your policy's coverage limits
  • Promptly responding to carrier requests for information or documentation

4. Payment Terms

Insurance-Funded Repairs

For insurance claims, payment is typically processed as follows:

  • Your insurance carrier issues payment directly to you and/or Texas Hail & Dent
  • If you receive the insurance check, payment is due upon vehicle pickup
  • Any deductible or uncovered amounts are due upon completion of repairs
  • We accept cash, check, and major credit cards (Visa, MasterCard, American Express, Discover)

Self-Pay Repairs

For repairs not submitted to insurance:

  • Payment is due in full upon completion of work
  • We require a 50% deposit for repairs exceeding $2,500
  • Vehicles will not be released until payment is received in full

Late Payment

If payment is not received within 30 days of completion, we reserve the right to:

  • Charge interest at the maximum rate permitted by Texas law (currently 18% annually)
  • Retain possession of your vehicle until payment is received (mechanic's lien)
  • Pursue collection through legal channels, including small claims court
  • Report delinquent accounts to credit bureaus

5. Warranty and Guarantees

Workmanship Warranty

We provide a national lifetime warranty on all paintless dent repair (PDR) work performed by our Master Technicians. This warranty covers:

  • Defects in workmanship (dents returning to original position)
  • Paint cracking or chipping resulting from PDR process
  • Structural failures caused by improper repair technique

Paint and Panel Warranty

Panel replacement and refinishing work is warranted for 3 years from date of completion against:

  • Paint peeling, blistering, or fading (normal wear excluded)
  • Color mismatch or blending defects
  • Adhesion failures or clear coat delamination

Warranty Exclusions

Our warranty does NOT cover:

  • New damage from subsequent hail storms, collisions, or vandalism
  • Damage caused by improper vehicle maintenance or care
  • Normal wear and tear, including stone chips or environmental oxidation
  • Repairs performed by unauthorized third parties after our work
  • Vehicles declared total loss by insurance carriers
  • Damage to vehicles with pre-existing structural or paint issues

Warranty Claims

To file a warranty claim, contact us at 1-888-TEX-HAIL. We will inspect the issue and, if covered, re-repair at no charge. Warranty claims must be submitted within the warranty period.

6. Limitation of Liability

Service Limitations

To the maximum extent permitted by Texas law:

  • Our liability for any claim arising from our services is limited to the amount you paid for those services
  • We are not liable for consequential, incidental, or indirect damages (e.g., lost wages, rental car costs, diminished vehicle value)
  • We are not liable for delays caused by parts availability, insurance carrier processing, or weather conditions
  • We are not responsible for personal items left in vehicles during repair

Pre-Existing Damage

We document vehicle condition before commencing work. We are not responsible for:

  • Pre-existing damage not related to hail or the repair scope
  • Hidden mechanical or electrical issues revealed during body panel removal
  • Vehicles with compromised structural integrity or rust

Force Majeure

We are not liable for delays or failures to perform caused by events beyond our reasonable control, including but not limited to: severe weather, natural disasters, supply chain disruptions, labor strikes, or government restrictions.

7. Client Responsibilities

By engaging our services, you agree to:

  • Provide Accurate Information: Supply truthful details about vehicle condition, insurance coverage, and claim history
  • Maintain Insurance: Keep active comprehensive coverage throughout the repair process if filing a claim
  • Remove Personal Items: We are not responsible for items left in vehicles. Remove all valuables before service
  • Authorize Access: Grant our technicians reasonable access to your vehicle for the duration of repairs
  • Timely Pickup: Retrieve your vehicle within 5 business days of completion notification. Storage fees of $25/day may apply thereafter
  • Inspect Work: Inspect completed repairs before leaving our facility. Report any concerns immediately

8. Dispute Resolution

Good Faith Resolution

If you are dissatisfied with our services, contact us immediately at 1-888-TEX-HAIL or info@txhaildent.com. We commit to resolving complaints in good faith within 10 business days.

Mediation

If informal resolution fails, both parties agree to attempt mediation before pursuing litigation. Mediation will be conducted in Abilene, Texas, with costs split equally between parties.

Governing Law and Venue

These Terms are governed by the laws of the State of Texas. Any legal action arising from these Terms or our services must be filed in Taylor County, Texas. Both parties consent to the exclusive jurisdiction of courts in Taylor County.

Arbitration Waiver

You retain the right to pursue claims in small claims court (for claims under $20,000) without mandatory arbitration.

9. Cancellation and Rescheduling

Client Cancellations

You may cancel or reschedule your appointment by providing at least 24 hours' notice. Cancellations with less than 24 hours' notice may result in a $50 scheduling fee if parts have been ordered or work has commenced.

Company Cancellations

We reserve the right to cancel or reschedule appointments due to:

  • Severe weather or unsafe working conditions
  • Parts delays or supply chain disruptions
  • Technician illness or emergency
  • Discovered vehicle safety issues requiring immediate attention

We will notify you as soon as possible and work to reschedule at your earliest convenience.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Texas Hail & Dent Co. or our licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works without our written permission.

You grant us permission to use before/after photos of your vehicle for marketing purposes (website, social media, promotional materials) unless you explicitly opt out in writing.

11. Referrals and Reviews

We encourage honest reviews and referrals. However:

  • We do not pay for positive reviews or offer incentives contingent on favorable feedback
  • Any referral bonuses or discounts are disclosed transparently
  • We reserve the right to request removal of defamatory or factually inaccurate reviews

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website with an updated "Last Updated" date. Continued use of our services after modifications constitutes acceptance of the revised Terms.

For material changes affecting existing service agreements, we will attempt to notify you via email or phone.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, along with our Privacy Policy and any written service agreements, constitute the entire agreement between you and Texas Hail & Dent Co. regarding our services. These Terms supersede any prior oral or written agreements.
